| Dodávateľ je podľa obchodného alebo iného registra oprávnený dodať predmet zákazky. |
| Dodávateľ sa zaväzuje, že všetky komponenty, ktoré tvoria predmet zákazky, sú originálne produkty výrobcu, dodané cez autorizovaný distribučný kanál a sú určené pre použitie v Slovenskej republike, prípadne v regióne, ktorého je Slovenská republika súčasťou. |
| Dodávateľ sa zaväzuje všetky dodávané komponenty, ktoré tvoria predmet zákazky, dodať nové, nerepasované a zabalené v originálnom balení. |
| Objednávateľ požaduje, aby všetky komponenty, ktoré tvoria predmet zákazky, boli spôsobilé na poskytovanie servisnej podpory od výrobcu. Objednávateľ má s výrobcom uzatvorenú zmluvu pre poskytovanie servisnej podpory na zariadenia, ku ktorým sú dodávané komponenty zakupované. V prípade, ak výrobca odmietne poskytnúť servisnú podporu dodaným komponentom, ktoré tvoria predmet tejto zákazky, objednávateľ si vyhradzuje právo okamžite odstúpiť od tejto zmluvy. |
| Dodávateľ vyhlasuje, že je autorizovaným obchodným partnerom výrobcu. Dodávateľ do 7 dní od uzavretia zmluvy poskytne mailom objednávateľovi informáciu o tomto partnerstve. |
| Dodávateľ sa zaväzuje dodať predmet zákazky do miesta plnenia, vrátane realizácie inštalácie v mieste plnenia, najneskôr do 60 dní odo dňa nadobudnutia účinnosti zmluvy. |
| Dodávateľ je povinný určiť celkovú cenu za predmet zákazky tak, aby zahŕňala všetky a akékoľvek náklady spojené s plnením zmluvy najmä dopravu do miest plnenia, inštaláciu v miestach plnenia, odstraňovanie chýb počas záručnej doby. |
| Miesto plnenia je v sídle obstarávateľa. |
| Nedodržanie predchádzajúcich povinnosti sa považuje za podstatné porušenie povinností Dodávateľa. |
| Ak je Dodávateľ identifikovaný pre DPH v inom členskom štáte EÚ a tovar bude do SR prepravený z iného členského štátu EÚ, tento Poskytovateľ nebude pri plnení Zmluvy fakturovať DPH. Vo svojej Kontraktačnej ponuke však musí uviesť príslušnú sadzbu a výšku DPH podľa zákona č. 222/2004 Z.z. a cenu vrátane DPH. Objednávateľ nie je zdaniteľnou osobou a v tomto prípade je/bude registrovaný pre DPH podľa § 7 zákona č. 222/2004 Z.z. a bude povinný odviesť DPH v SR podľa zákona č. 222/2004 Z.z.. |
| Platba do 30 dní po doručení faktúry, ktorá bude vystavená po prevzatí predmetu zmluvy. |
